RENTAL AGREEMENT

This Rental Agreement ("Agreement") sets forth the terms governing automatic card payments, price list, and privacy policy. These provisions, together with the General Rental Terms ("General Rental Terms"), constitute the complete agreement between the parties. The General Rental Terms can be accessed via the Dribe Application. 

PICK-UP/DROP-OFF LOCATION

The Lessee shall collect the listed Vehicle(s) from [PICK-UP LOCATION] as specified in the App.

The Vehicle must be returned at the same location it was originally picked off, as indicated in the App.

PICK UP TIME

From [PLANNED PICK-UP DATE] ("Pick-up Date"), the Vehicle can be picked up.

DROP-OFF TIME

The Vehicle must be returned no later than the [RETURN DATE] at 15:00 ("Drop off time") – unless the Rental Agreement is terminated by the Lessor at an earlier time in accordance with this rental agreement ("The Rental Agreement") and the attached General Rental Terms and Conditions.

If the Vehicle is not returned at the agreed Drop Off Time, the Lessee is responsible for rental charges until the time the Vehicle is returned to the Lessor.

RENTAL PERIOD, BINDING PERIOD AND TERMINATION

The total rental period ("Rental period") is [RENTAL PERIOD] days and starts from the specified pick-up time mentioned above.

In the event that the Lessee is picked up later than the Pick-up date, the Lessee will be liable for payment of rental fees from the pick-up time specified in this Rental Agreement.

The Lessee is aware that there is no right of withdrawal for the rental of the Vehicle in accordance with consumer contract law. More specifically, The Lessee have no right of withdrawal from the time when the Lessee initiates a lease by selecting the relevant option through the Dribe Application, (i) requests and approves the commencement of the provision of the lease service during the cooling-off period, and (ii) is deemed to have provided his/her consent for waiving his/her right of withdrawal. However, the Lessor has established the following rules for cancellations: If the cancellation takes place less than 30 days before the Pick-up Date, the Lessee will be charged [INSERT RATE] % of the price for the rental period. If the cancellation takes place more than 30 days before the Pick-up Date, the Lessee will only be charged [INSERT RATE] % of the price for the rental period. Additionally, the Lessee has the option to purchase cancellation insurance separately through the App, as stated in the Price List. 

The Lessee cannot terminate the Rental Agreement during the agreed Rental Period (“Binding Period”), and the Lessee is, therefore, bound the entire rental period (“Binding Period”). However, the Lessee has the option to return the Vehicle to the Lessor before the agreed Return Time. In this case, the Lessee will not be entitled to a proportional refund for any unused rental days. 

This means that the Lessee can return the Vehicle to the Lessor before the agreed Return Time, but in that case, the Lessee will not be entitled to a proportional refund for unused rental days within the agreed rental period (“Binding Period”).

On the other hand, the Lessor has the right to terminate the Rental Agreement with a 7-day notice period.

The Lessor holds the right to terminate the rental agreement prior to its beginning [PLANNED PICK-UP DATE], in case of the Lessee fails to provide documentation of a valid driver’s license, as a valid driver’s license is a requirement for a user account with Dribe in accordance with the Terms of Use. In this scenario the cancellation policy will not apply, and the Lessee will not be charged.

PRICE AND PAYMENT

The rental fee for the Vehicle is [PRICE] including VAT.

The first payment is due for payment at the Pickup time. The payment is reserved on the Lessee's card 4 days before the payment date. For automatic card payments, the 'Terms for Automatic Card Payments' apply. 

INCLUDED IN THE RENT

In addition to the Vehicle, the agreed rental fee includes the following:

Green ownership tax

Cleaning of the Vehicle

Liability and comprehensive insurance coverage (with a deductible of up to €1000 per incident for the Tenant)

Service and maintenance expenses, subject to the restrictions outlined in the general rental terms and conditions.

INCLUDED KILOMETERS

Number of included kilometers is [300] km per day.

The rental fee is based on the agreed driving requirement. If the agreed number of kilometers is exceeded, the Lessee will be separately billed for the excess kilometers at the rate specified in the Rental Agreement.

The included kilometers only apply to this specific Rental Agreement and cannot be offset against excess kilometers in other rental agreements.

EXCESS KILOMETERS

Excess kilometers, if any, will be assessed upon the Vehicle's return and billed at the agreed-upon rate per additional kilometer. The Lessee is responsible for settling any charges related to overdriven kilometers, fines, or any other outstanding amounts accrued by the Lessor due to the Lessee's or any Driver's utilization of the Vehicle throughout the Rental Period.

THE USE OF THE VEHICLE

The Lessee and the Driver of the Vehicle must comply with the Rental Agreement, the General Rental Terms, and applicable laws and regulations. In case of any failure to comply, the Lessee shall indemnify the Lessor for any loss suffered as a result.

The Vehicle shall not be employed for racing, any type of commercial passenger or cargo transport, or any other activity necessitating specific authorization.

PARKING CHARGES, FINES AND FEES

As if the Lessee was owner of the Vehicle, the Lessee is responsible for any violations that occur during the Rental Period and are related to the Lessee's or any Driver’s use of the Vehicle. The Lessee is liable for all fees, fines, and penalties, including road tolls, that may arise during the use of the Vehicle throughout the Rental Period and until the time the Vehicle is returned to the Lessor. The Lessee agrees that the Lessor is entitled to charge these costs to the Lessee's card, plus the administrative fee specified in the Lessor's Price List, as described in the General Rental Conditions.

DRIVER(S)

The Vehicle may only be driven by the Lessee or the listed Driver(s). If the Vehicle is damaged while being driven by anyone other than the Lessee or the Driver(s), the Lessor's insurance company may seek recourse against both the Lessee and the Driver(s) for the incurred damages and losses.

The Lessee is responsible to the Lessor for any damage to the Vehicle and any losses that the Lessor may suffer as a result of the Lessee's rental of the Vehicle, regardless of who is driving it.

INJURIES AND ACCIDENTS

The Lessor has taken out third-party liability and comprehensive insurance for the Vehicle, where the Lessee and the Driver(s) are considered insured parties.

THE LESSEE HAS A DEDUCTIBLE RISK OF up to €1000

The deductible amount is up to 1000€. The specific deductible amount for the Vehicle within this Agreement can be found on the Dribe website: www.dribe.gr

However, the insurance company may claim recourse against the Lessee or the Driver(s) for the full loss in the following cases:

If the person in question has driven the Vehicle without a valid driver's license.

If the Vehicle is driven by someone other than the Lessee/Driver(s).

If the damage is caused by gross negligence, according to Greek legislation.

In the event of significant damage, an accident, or breakdown, the Lessee must immediately inform the Lessor by phone at 2109981110

The Lessee is obliged to report any damage to the Vehicle to the Lessor's insurance company, Allianz Hellas S.A. Contact information can be found on the Dribe application and www.dribe.gr. The Lessee's reporting obligation also includes minor dents, stone chips, and cosmetic damages.

In the event of a breakdown, the Lessor's mobility service must be used. Contact information for the Lessor's mobility service can be found on the Dribe application and www.dribe.gr

CHANGES TO THE RENTAL AGREEMENT

The Lessor is entitled to make changes to the terms of the Rental Agreement, including prices and fees, as stated in clause 13 of the General Rental Terms. Significant changes will be notified to the Lessee with a notice period of at least 30 days prior to the end of a rental period, and during the notice period, the Lessee may terminate the Rental Agreement with a notice of 7 days, regardless of the Binding Period.

Significant changes will be communicated individually to the Lessee, for example, via email or SMS, as specified in the section on 'Communication' in the Rental Agreement.

COMMUNICATION

The Lessee is obligated to provide the Lessor with their current name, address and contact information, including email, phone number, etc.

Communication between the Lessee and the Lessor, including notifications about changes and requests for the Lessee's acceptance of significant changes, will be considered received by the Lessee when the message is sent via push notification in the Dribe application and subsequently sent by email or SMS.

TRANSFER

The Lessee is not entitled, either wholly or partially, to transfer their rights and/or obligations under the Rental Agreement without the prior written consent of the Lessor, unless otherwise required by law.

The Lessor is entitled to transfer its rights and obligations under the Rental Agreement, including agreements made regarding payment services and similar matters. However, such a transfer may be considered a significant change, in which case the Lessee will be notified in accordance with clause 13 of the General Rental Terms.

OTHER TERMS

By confirming this Rental Agreement, the Lessee declares that they are aware of and have accepted the entire contractual basis, including the Lessor's General Rental Terms, Terms for Automatic Card Payment, Price List, Privacy Policy, and the pickup and return receipts issued by the Lessor. The General Rental Terms are available at all times on Dribe's mobile application and on Dribe's website www.dribe.gr

Furthermore, reference is made to the current legislation, including the Rental Regulation [INSERT LOCAL RELEVANT LEGISLATION]

SIGNATURE

The rental agreement is signed, (and hereby accepted) and stored digitally by the Lessor. A copy of the accepted rental agreement will be available to the Lessee in the Dribe application and can be downloaded by the Lessee as a PDF.

Delivery receipt, return receipt, and any condition report are prepared in two copies, of which the Lessor and the Lessee each receive one copy.
